2. What data we collect
- Contact form: first name, last name, email address, phone number, enquiry type and the information you include in your message (for example, details of a project or company).
- Correspondence: data you send us by email, telephone or LinkedIn.
- Technical data: IP address and basic browser information processed automatically by our hosting and security providers to deliver the website and protect it against abuse.
Please do not send us special categories of data (such as health data) or third parties’ personal data unless you are entitled to do so.
3. Why we use your data and on what legal basis
- To reply to your enquiry and send you the information you request — based on your consent (art. 6.1.a GDPR) and on steps taken at your request before entering into a contract (art. 6.1.b GDPR).
- To assess a project and, where you ask us to, present it to potential banks, lenders or investors — based on pre-contractual measures and, where applicable, the contract with you (art. 6.1.b GDPR). We will not share your project with any funder without first agreeing it with you.
- To manage our professional relationship with developers, lenders, investors and their representatives — based on our legitimate interest in conducting business-to-business relationships (art. 6.1.f GDPR).
- To comply with legal obligations, including, where applicable, anti-money laundering and know-your-customer checks under Spanish Law 10/2010, and tax and accounting obligations (art. 6.1.c GDPR).
- To keep the website secure and working properly — based on our legitimate interest (art. 6.1.f GDPR).
We do not use your data for automated decision-making or profiling, and we do not sell it.
4. Who receives your data
- Service providers acting on our behalf, under data processing agreements: Webflow, Inc. (website hosting and contact form), Google (email and office tools) and Cloudflare, Inc. (website security and spam protection).
- Banks, lenders, investors and professional advisers (such as lawyers, valuers or notaries) involved in a transaction, only where necessary for your project and as agreed with you.
- Public authorities, courts and regulators, where required by law.
5. International transfers
Some of our providers are based in, or may access data from, the United States. Where this happens, transfers are protected by the European Commission’s adequacy decision for the EU-US Data Privacy Framework for certified companies or by the European Commission’s Standard Contractual Clauses.
6. How long we keep your data
- Enquiries that do not lead to a business relationship: up to two years from our last contact, unless you ask us to delete them sooner.
- Clients and transaction counterparties: for the duration of the relationship and afterwards for the periods required by law (for example, up to ten years where anti-money laundering legislation applies).
7. Your rights
You may request access to your data, its rectification or erasure, the restriction of processing, data portability, or object to processing, and you may withdraw your consent at any time without affecting the lawfulness of earlier processing. To exercise your rights, email hh@estatefunds.co, indicating the right you wish to exercise. We may ask you to verify your identity.
If you believe your rights have not been respected, you may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos) at www.aepd.es.
8. Security
We apply appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access, and we treat project information confidentially.
9. Minors
This website is intended for professionals and is not directed at people under 18.
